OLGT 2023-21A: Cross Programs: Extension and Redesignation of Temporary Protected Status (TPS) for Haiti
This OLGT is being reissued as OLGT 2023-21A to clarify that Cuban and Haitian noncitizens with a status of TPS might qualify as Cuban/Haitian Entrants for purposes of TAFDC and SNAP eligibility.
The Department of Homeland Security (DHS) has announced the extension and re-designation of Haiti for Temporary Protected Status (TPS) for 18 months. This extension and re-designation will be in effect from February 4, 2023 through August 3, 2024.
Individuals who are approved or have pending status for TPS are considered Permanently Residing Under Color of Law (PRUCOL) for purposes of EAEDC eligibility, and accordingly, may be eligible for EAEDC provided they meet all other EAEDC nonfinancial and financial requirements.
Important: Individuals who are approved or pending for TPS are not eligible for SNAP or TAFDC benefits but might qualify under a different noncitizen status, such as Cuban/Haitian Entrant status. Accordingly, applications from Haitian or Cuban noncitizens should not be denied based on noncitizen status prior to consulting with the Procedural Mailbox.
