BOR 0015 4145 42
Date:
The claimant was denied unemployment benefits during his leave of absence because he was not available for full-time work. The Board reversed the denial. The claimant could not work his regular full-time truck-driving shift due to child-care issues. The Board, however, held him remain able and available to perform up to 35 hours of other forms of work. The Board concluded that (holding that a claimant who could not work a regular full-time truck-driving shift due to childcare issue was nonetheless able and available as he could perform up to 35 hours of other forms of work). the claimant’s limited availability did not effectively remove him from the labor force, and thus was entitled to receive benefits.
