OLGT 2022-36: EAEDC: Designation of Temporary Protected Status (TPS) for Ukraine

Due to the ongoing armed conflict and extraordinary and temporary conditions in Ukraine that prevent Ukrainian nationals, and those of no nationality who last habitually resided in Ukraine, from returning to Ukraine safely, the Department of Homeland Security (DHS) has recently announced a new designation of Temporary Protected Status (TPS) for Ukraine for an 18-month period beginning on April 19, 2022 through October 19, 2023.

This TPS designation enables Ukrainian nationals (and individuals without nationality who last habitually resided in Ukraine), who have continuously resided in the United States since April 11, 2022, and who have been continually physically present in the United States since April 19, 2022 to file initial applications for TPS status.

Individuals who are approved for or who have pending TPS status must have documentation from USCIS verifying their temporary status. Once verified, they are considered Permanently Residing Under Color of Law (PRUCOL) for DTA application purposes. These individuals may be eligible for EAEDC provided they meet all other EAEDC nonfinancial and financial requirements.

Individuals who are approved or pending for TPS are not eligible for SNAP or TAFDC benefits, unless they qualify under a different noncitizen status, i.e., Refugee.
