OLGT 2022-33: EAEDC: Designation of Temporary Protected Status (TPS) for Sudan
The Department of Homeland Security (DHS) has recently announced a new TPS designation for Sudan that allows Sudanese nationals, (and individuals having no nationality who last habitually resided in Sudan) who have continuously resided in the United States since March 1, 2022, to file initial applications for TPS. This enables nationals of Sudan who currently have TPS and whose TPS Documents were extended pursuant to court orders through December 31, 2022, to also file an initial application under this new designation. This allows current TPS beneficiaries to retain their status without a gap in coverage if they are otherwise eligible. This new designation is in effect for 18 months as of April 19, 2022 and will remain through October 19, 2023.
Individuals who are approved for or who have pending TPS status must have documentation from USCIS verifying their temporary status. Once verified, they are considered Permanently Residing Under Color of Law (PRUCOL) for DTA application purposes. These individuals may be eligible for EAEDC provided they meet all other EAEDC nonfinancial and financial requirements.
Individuals granted TPS are eligible for EAEDC. Individuals who are approved for or pending for TPS are not eligible for TAFDC or SNAP unless they qualify under a different noncitizen status, i.e., Refugee.
