In the Matter of MD, FH# 20191330
Date:
Affirmed for neglect and reversed for abuse - DCF did have reasonable cause to support a finding of neglect by Appellant daycare provider for falling asleep while supervising children in her daycare when 1) the three children were consistent with their own and each others' testimonies; 2) Appellant did not make a persuasive argument denying the allegations and later received a medical diagnosis that caused her to be very fatigued; and 3) the children disclosed partaking in a variety of unsafe and unsupervised activities that occurred while they claimed Appellant was sleeping on the couch. DCF did not have reasonable cause to support a finding of abuse by Appellant for one minor incident with no proof of physical injury to the child involved.
