Skilled Nursing Facility patient sued on a denial of Medicare coverage by his Medicare Advantage plan. The District Court remanded for a hearing to determine whether outpatient services were, as a practical matter, available and feasible. The burden of proof on "available and feasible" falls on the plan, not the patient.
