BOR (Board of Review)

Board reversed R/E decision that client left job voluntarily.  Board ruled that client quit under the reasonable belief that he was going to be fired. The client had performance issues because of the many stressors going on in his private life and had been warned in the past. The HR rep made statements in a disciplinary meeting that would have reasonably have let the claimant to conclude that he would be fired if he had another performance problem. When he did have another performance problem he gave a letter of resignation. The claimant had repeatedly tried to improve his performance and was convinced that he would never meet expectations. Also, he did not ask for a leave of absence because he did not think that he would have been eligible.

Client acted pro se at the hearing after NLS advice.
